The following is an update on the timelines regarding the upcoming Municipal Elections.
Advance Polls will be held on May 2nd and May 4th, with Election Day on May 11th.
Candidates have ten (10) days from the day of election to apply for a recount. Therefore, the earliest date the new council can take the oath of office is May 23rd, 2026. I, as the Supervisor, will remain in place until the new Council has taken the oath of office. Once the new council is in place, the Local Governance Commission will issue Orders to terminate the Supervisor role.
During the period from May 11th until the new Council has taken the oath of office, the Supervisor must abide by the following provision of the Local Governance Act:
Restriction on powers of outgoing council
56(1) During the period commencing on the day of a general election and ending on the day of the first meeting of an incoming council, the outgoing council shall continue to exercise its powers in relation to the day-to-day activities of the local government but shall not:
- make, amend or repeal a by-law under the authority of this or any other Act,
- become a party to any agreement, contract, instrument or any other document other than those provided for in the estimates adopted under paragraph 99(2)(a) for the current year,
- borrow or make payments of funds other than those provided for in the estimates adopted under paragraph 99(2)(a) for the current year,
- purchase or dispose of capital assets, or
- appoint or dismiss officers or employees.
56(2) If an outgoing council acts in contravention of subsection (1), the action is void and has no effect.
56(3) Despite subsections (1) and (2), an outgoing council may do those things referred to in subsection (1) if
- it is in the public interest and is urgently required, or
- it is authorized by a by-law made before the day of the general election.
